    Exclamation Completely OT - But, needed to mention this

    So, I've resisted the urge to play WoW since its inception, although I am the kind of person who would enjoy it. I just clicked on an ad link that said "play free up to lvl 20" so hell, why not?

    Don't ask me why, but I actually clicked on the Terms of Use, just to see how long it was. After a couple sections, I decided to just peruse the section titles. I happened to stumble upon this gem at

    12.RESTRICTIONS AND CONDITIONS OF USE
    ---
    D. User Content.
    "User Content" means any communications, images, sounds, and all the material and information that you upload or transmit through a Game client or the Service, or that other users upload or transmit, including without limitation any chat text. You hereby grant Blizzard a perpetual, irrevocable, worldwide, paid-up, non-exclusive, license, including the right to sublicense to third parties, and right to reproduce, fix, adapt, modify, translate, reformat, create derivative works from, manufacture, introduce into circulation, publish, distribute, sell, license, sublicense, transfer, rent, lease, transmit, publicly display, publicly perform, or provide access to electronically, broadcast, communicate to the public by telecommunication, display, perform, enter into computer memory, and use and practice such User Content as well as all modified and derivative works thereof. To the extent permitted by applicable laws, you hereby waive any moral rights you may have in any User Content.


    Now, I don't know if that is in the EULAs and ToUs in all mmorpg games. But what it means in a nutshell is that ANYTHING you post/say/do through your character on WoW, is 100% owned by them from now until eternity, without exclusion or exception. Meaning if you come up with some witty catch phrase and somehow it become a notable phrase that was worth money, you have no legal claim to it, and they own it?

    Fucking nuts.

    If i'm correct ELUAs aren't always enforceable depending on the country and what's in question, since a ELUA is only a contract.

    It's non-exclusive and it's only a licence for them to use your copyright. You still own that copyright. The copyright is always owned by the author. You have just granted them a licence to use your copyright in various ways.

    It doesn't prevent you from doing anything.

    They can use your witty phrase freely. But you can also put it inside your own copyrighted work and they can't do anything about it, except they will still have a license to use it how the want. They do not get any royalties though. You own it. They just have a licence.

    Okay, so that means you can use it without them infringing on you; but, they can do the same.

    If that's the case, then I still would say they will be far more able to utilize/market/distribute said material, and therefore create wealth from your content. Just thought it was notable.

    However, that DOES make it far less insidious!

    Everything killtrend said, moreover, EULA's aren't federally recognized, and you can contest them if something is deemed unreasonable.

    Basically, EULA's talk big but have no backup to boot. The only things they enforce are rules that are also already federally enforced.
