Jasmine's is a negative effect as defined in the rulebook. They stick for their specified duration and have visual markers to show it as well. It's how Poison Gas can work despite being in the grave moments after playing it.
If there's no visual marker for an effect then it's tied to some source that must be in play. In both cases, the board state you can see (through cards in play and markers on them) always dictates what effects are occurring.
We have considered renaming these to be clearer that there is a specific meaning rather than more generally intuited meaning of "negative effect" but did not prioritise is.
