Whenever another player sells a legendary it becomes available at the merchant. The merchant himself opens a bunch of boosters on occassions and sells the contents of those - including any legendaries!
But a lot of people is on the lookout for these bad boys so you'll have to be quick and lucky if you want to get some of these bad boys!

Keep checking the merchant. eventually, it will restock.
If you are fortunate, someone will sell one back to the merchant. Then you can buy it right away.
Someday soon the Card Market will allow you to buy from other players.
I do not know when any of these will happen.
